Jack De Gioia

Jack works as a Managing Associate of the Building and Construction team and also works closely within our Strata Division.

Prior to joining Bannermans, Jack worked in multiple specialist and multidisciplinary construction practices in relation to the following:

  • front end contract drafting, advisory positions and negotiations;
  • case management of construction disputes across both NSW, Victoria and the ACT;
  • Security of Payment claims and debt recovery matters
  • Advocacy on behalf of numerous clients in the Local Court, District Court, Supreme Court and NSW Civil & Administrative Tribunal, as well as advocacy for alternate dispute resolution proceedings for both residential construction and commercial disputes; and
  • back end dispute resolution including SOPA claims and litigation acting for developers, T2/T3 contractors and subcontractors and consultants in a mix of residential and commercial projects.

At Bannermans, Jack undertakes the following work:

Management and Leadership

  • Acting as one of the Managing Associates of the Construction team, with responsibility for overseeing and coordinating the team’s day-to-day operations in conjunction with the other Managing Associate, ensuring the effective management of workloads, matters and resources across the team.
  • Working collaboratively to coordinate the team’s overall operations, support the development and performance of team members, maintain consistency in the delivery of legal services and ensure the efficient progression of client matters.
  • Managing complex construction disputes and providing strategic legal advice to clients across a broad range of building and construction matters.

Building and Construction

  • Acting for clients in pre-dispute matters relating to building defect claims and litigated matters in the NSW Civil and Administrative Tribunal, District Court and NSW Supreme Court;
  • Advising clients on building defects, insurance claims, alternate dispute remedies, and relevant limitations periods pursuant to both the Home Building Act, Design & Building Practitioners Act and other relevant legislation.
  • Reviewing and advising on building contracts, consultancy agreements and project management agreements with various stakeholders including owners, builders and consultants;
  • Assisting owners in relation to the enforcement and supervision of work orders and settlement agreements for rectification works;
  • All aspects of claims for claims relating to property disputes, building encroachment and disputes pertaining to boundaries;
  • Drafting and resolution of settlement agreements across all facets of matters; and
  • Engaging with technical building experts such as building consultant specialists, surveyors and engineers.

Strata

  • Drafting common property works by-laws and strata scheme by-laws;
  • Advising owners and owners corporations about development, property and strata issues including Access Deeds and Easements;
  • Preparing amendments to community management statements;
  • Handling interim and substantive strata disputes and proceedings in the NSW Civil and Administrative Tribunal, including but not limited to compulsory strata appointments, repair and maintenance claims and strata dispute orders;
  • Negotiating and advising on grant of rights of use or development of lots or common property such as easements, licensing and leasing;
  • Assisting owners corporations in mould cases, structural matters and section 106 of the Strata Schemes Management Act 2015 disputes;
  • Assisting owners corporations with insurance issues in relation to legal defence cover, repair and maintenance obligations; and
  • Advising owners corporations on various aspects of general meetings and strata committee meetings.

Diploma of Practical Legal Training, Law (The College of Law Australia) 2021
Admitted as a Lawyer of the Supreme Court of NSW
Admitted as a Lawyer of the High Court of Australia
