When do the recordings need to be produced for a Section 182 inspection?

Posted 27 February 2025

Category:

As set out in Q10, If the recordings are kept by the owners corporation, then the recordings will be treated as records of the owners corporation. The owners corporation will need to produce the records for inspection at a request by a relevant party.

However, if the recordings are kept by a third-party provider, then the recordings will not need to be produced for inspection for the purpose of Section 182 of the SSMA. It would be a matter of the owners corporation, or the strata committee or the strata management agent with the delegated authorisation to decide to call upon the records with the contractor who is storing the data subject to the contract as entered into between the owners corporation and the contractor.
