What happens if the by-law is invalid or partially invalid?

  • A by-law has no force or effect to the extent that it is inconsistent with the Strata Schemes Management Act 2015 or any other law and can be ignored as is if does not exist.
  • Alternatively, the NSW Civil and Administration Tribunal and the Supreme Court has power to declare a by-law invalid and for it to be removed from the schemes registered by-law’s.
