What approvals are required for an owners corporation to install cameras?

It will depend on whether the cameras are shown in the original registered strata plans.

If the cameras are shown in the registered strata plan

If at the registration of the strata plan, cameras are included and shown on the strata plan, the replacement or repair of the cameras will be under Section 106 of the SSMA. It is within the owners corporation’s duty to maintain and repair the common property including renewal and replacement of the common property.

Section 106 of the SSMA provides:

“106 Duty of owners corporation to maintain and repair property

  1. An owners corporation for a strata scheme must property maintain and keep in a state of good and serviceable repair the common property and any personal property vested in the owners
  2. An owners corporations must renew or replace any fixtures or fittings comprised in the common property and any personal property vested in the owners ”

The owners corporation will only need to pass a general resolution for such repair and replacement. If the strata committee or strata management agent also has the authorisation, then the strata committee or the strata management agent can also resolve to repair and replacement.

If installation of new cameras

If there is no camera shown in the registered strata plan and the owners corporation intends to install new cameras. It will be under Section 108 of the SSMA, the owners corporation will need to pass a special resolution for the installation.
