When undertaking remedial or renovations works one must consider whether planning approval is required given the numerous consequences if it is in fact needed. Our Town Planning Advice considers:

  • the Town Planning Certificate from Council;
  • the Development Application’s (DA) for the building;
  • the specified applicable Local Environmental Plan’s (LEP);
  • the deemed to satisfy provisions;
  • the scope of works; and
  • the Annual Fire Safety Statement (AFSS).

Our advice:

  • Will determine what, if any, planning approval is required for the remediation or renovations works.
  • Apart from waterproofing works, if it is exempt and not roof or wall cladding works, it can be relied upon for exempting the need for compliance with the Design & Building Practitioners Act 2022.
  • It can only be relied upon by the designer when making a Design & Building Practitioner Act (D&BPA) declaration.
  • It can also be relied upon by the private certifier for approving a Complying Development Certificate.
