Kayla Khamis

Kayla has been with Bannermans since July 2017, starting in a legal administrative role while completing her university studies. Kayla works across both the Building, Construction and Strata teams. Kayla has built extensive experience, becoming a key resource for construction-related legal issues in NSW. She has played a pivotal role in managing complex legal matters within the construction sector, offering valuable guidance and favourable outcomes across diverse projects and disputes. With a deep understanding of construction law, Kayla skillfully addresses client-specific needs with tailored, effective solutions.

Throughout her time at Bannermans, Kayla has worked on a broad spectrum of construction matters, including the following tasks:

Building and Construction

  • Acting for owners corporations of various sizes, ranging from 3-350+ lots, against builders and developers in building defect disputes;
  • Advising owners corporations on building defects, insurance claims, legal remedies, limitation periods, and current issues such as combustible cladding and the Design and Building Practitioners Act (DBPA);
  • Advising builders and developers on the DBPA and building work rectification orders (BWRO);
  • Appearing on behalf of owners corporations in building defect claims in the NSW Civil & Administrative Tribunal and Supreme Court of NSW;
  • Running the day-to-day carriage of litigation matters from providing advice to the client, preparing letters of demand, preparing applications commencing proceedings and running the proceedings until determination of the Court or Tribunal;
  • Assisting clients with contract negotiations, Fair Trading disputes and HBCF insurance claims;
  • Assisting owners corporations obtain freezing orders against Developers dispersing assets;
  • Coordinating with technical experts, including consultants, surveyors, and engineers;
  • Assisting owners corporations with the enforcement and supervision of work orders and settlement agreements for rectification works;
  • Reviewing building contracts and advising both builders and owners corporations;
  • Engaging in alternative dispute resolution, including mediation; and
  • Drafting deeds of settlement and agreements.

Strata

  • Drafting, consolidating, and registering by-laws;
  • Reviewing and advising on by-laws;
  • Preparing applications for strata disputes in NCAT;
  • Advising owners corporations on unauthorized works and maintenance responsibilities under the Strata Schemes Management Act 2015; and
  • Assisting with fire order compliance, particularly concerning combustible cladding.

Qualifications/Memberships

  • Graduate Diploma of Legal Practice, 2020
  • Bachelor of Laws, Australian Catholic University, 2019
  • Admitted as a Solicitor of the Supreme Court of NSW and High Court
  • Member of the Law Society of NSW
