Jack De Gioia

Jack works as a lawyer in the Building and Construction team and Strata team.

Prior to joining Bannermans, Jack worked in multiple mixed specialist construction practices carrying out the following:

  • front end contract drafting, advisory and negotiations;
  • assisting in the case management of construction disputes across NSW, Victoria and the ACT;
  • Security of Payment claims and debt recovery matters
  • acting on behalf of numerous clients in Court, Tribunal and alternate dispute resolution proceedings for both construction and commercial disputes; and
  • back end dispute resolution including SOPA claims and litigation acting for developers, T2/T3 contractors and subcontractors and consultants in a mix of residential and commercial projects.

At Bannermans, Jack undertakes the following work:

Building and Construction

  • Acting for owners corporations in pre-dispute matters relating to building defect claims and litigated matters in the NSW Civil and Administrative Tribunal, District Court and NSW Supreme Court;
  • Advising owners corporations on building defects, insurance claims, legal remedies, relevant limitations periods;
  • Reviewing building contracts, consultancy agreements and project management agreements and advising various stakeholders including owners corporations, builders and consultants;
  • Assisting owners corporations in relation to the enforcement and supervision of work orders and settlement agreements for rectification works;
  • All aspects of claims for and against strata companies including claims relating to defects, building encroachment and disputes over boundaries;
  • Drafting settlement deeds; and
  • Engaging with technical building experts such as building consultant specialists, surveyors and engineers.

Strata

  • Drafting common property works by-laws and strata scheme by-laws;
  • Advising owners and owners corporations about development, property and strata issues including access deeds and easements;
  • Handling interim and substantive strata disputes and proceedings in the NSW Civil and Administrative Tribunal;
  • Assisting owners corporations in mould cases, structural matters and section 106 of the Strata Schemes Management Act 2015 disputes;
  • Assisting owners corporations with insurance issues in relation to legal defence cover, repair and maintenance obligations; and
  • Advising owners corporations on various aspects of general meetings and strata committee meetings

Diploma of Practical Legal Training, Law (The College of Law Australia) 2021
Admitted as a Lawyer of the Supreme Court of NSW
Admitted as a Lawyer of the High Court of Australia
