What is a sustainability infrastructure by-law?

When considering whether a change to common property constitutes “sustainability infrastructure”, it’s important to assess the intended purpose behind the proposed alteration. The purpose of sustainability infrastructure may include any one or more of the following:

  • Enhancing energy efficiency or reducing energy consumption
  • Enhancing water efficiency or reducing water consumption
  • Preventing or reducing pollution
  • Reducing landfill waste
  • Promoting material recycling or recovery
  • Reducing greenhouse gas emissions
  • Enabling the use of sustainable forms of transportation, including electric vehicle charging stations.

Approval for a change to common property can also come in the form of a “sustainability infrastructure resolution”. This new resolution requires a simple majority (50% or more) of eligible voters present at the general meeting where the motion is considered.

However, it’s important to note that a sustainability infrastructure resolution may go beyond a common property rights by-law. It may also relate to financing sustainability infrastructure or changing the strata scheme’s by-laws for the purpose of installing or using sustainability infrastructure.
